O 2856COUNCIL BILL NO. 18-032 ORDINANCE NO. 2856 AN ORDINANCE REPEALING AND REPLACING IN ITS ENTIRETY SECTION 27-12- 6-17, PARKING RESTRICTIONS FOR RECREATIONAL VEHICLES, OF THE LAS CRUCES MUNICIPAL CODE 1997, AS AMENDED. The City Council is informed that: WHEREAS, it was determined at the September 11, 2017, work session that Las Cruces Municipal Code ("LCMC 1997"), Section 27-12-6-17, Parking restrictions for recreational vehicles, could be repealed and replaced to improve clarity and enforcement; and WHEREAS, a draft ordinance was presented at a public input meeting, then to the City Council but was tabled to clarify allowable parking time limits and permitting; and WHEREAS, a second public input meeting was held to present a new draft ordinance, in which the general consensus was that there were concerns about the unpermitted parking time; and WHEREAS, the final draft for adoption no longer allows unpermitted RV parking on residential streets, but allows eight hours to obtain the permit, and adds an additional day to the permitted time, which makes it six consecutive days for a maximum of 18 days in a 90 -day period; and WHEREAS, a 12 -month evaluation period will be put in place to allow for proper data to be gathered on how many permits are requested, how many citations are written, operational impact and the effectiveness of the ordinance. NOW, THEREFORE, be it Ordained by the Governing Body of the City of Las Cruces: THAT Las Cruces Municipal Code Section 27-12-6-17, Parking restrictions for recreational vehicles is hereby repealed and replaced, as shown in Exhibit "A", attached hereto and made part of this Ordinance, with an effective date of September 1, 2018. THAT City staff is hereby authorized to do all deeds as necessary in the accomplishment of the herein above. COUNCIL DISTRICT: N/A Drafter/Staff Contact: Elizabeth Teeters Department/Section: Administration/Cit Manager's Office Phone: 541-2181 City Manager Signature: G BACKGROUND / KEY ISSUES / CONTRIBUTING FACTORS: Ordinance 2566 amended the Las Cruces Municipal Code to include parking restrictions for recreational vehicles in residential areas of Las Cruces, and was adopted by the Las Cruces City Council on March 1, 2010. The ordinance allowed unlimited parking for recreational vehicles (RV's) with 4 wheels, and restricted larger RV parking except for brief periods of time for activities such as preparing for a planned trip. There are two main issues with the current ordinance: the wording is unclear and it is hard to enforce in the absence of a permitting process. At the work session on September 11, 2017, City Council directed that the ordinance needed to updated to improve clarity and enforcement. A public input meeting was held in October and a draft ordinance was presented at a City Council meeting on December 4, 2018. The City Council voted to table the issue until another draft ordinance could be presented that even further clarified the issues of permitting and the allowance of time an RV may park on the street. A revised draft ordinance (Attachment A) was then presented at a second public input meeting on March 1, 2018, in which the majority of the feedback concerned the amount of unpermitted parking time. That same draft was presented to the City Council at a work session on March 12, 2018, where Council expressed concern that it would be hard to enforce the unpermitted time, no matter how long the period was. (Continue on additional sheets as required) Rev. 02/2012 Council Action and Executive Summary Page 2 Based on the additional input, the ordinance that has been re -drafted and presented for adoption (Exhibit A) modifies permitting and parking time limitations. This draft no longer allows unpermitted RV parking on residential streets but allows eight hours to obtain a permit. It also adds one additional day to the permitted time an RV can be parked on the street since there is no longer time designated for loading and unloading without a permit. The number of allowable days of parking in a 90 -day period increased to 18 days so owners could ideally have 3 six-day periods. While Exhibit A is the recommended ordinance for adoption, Attachments A and B are alternative options that were drafted for comparison. Attachment A is the draft ordinance as it was presented at the March 12, 2018, work session and is provided as reference; six hours of unpermitted parking time in allowed. Attachment B changes the allotted time to park on the street without a permit from six to 12 hours based on some City Council and public input received. All these options clarify the ordinance language and provide for a permitting process to improve enforcement. Staff is recommending to adopt the proposed ordinance with an effective date of September 1, 2018, with a 12 -month evaluation period and no charges for permitting during this period. By sunrising the effective date, there will be time to setup the permitting process and for education and outreach, so the RV owners are prepared for the ordinance change. This period will also allow for proper data to be gathered on how many permits are requested, how many citations are written, operational impact and the effectiveness of the ordinance.
