02-08-17 DRC1 DEVELOPMENT REVIEW COMMITTEE (DRC) 2 3 Following are the minutes from the City of Las Cruces Development Review Committee 4 meeting held Wednesday, February 8, 2017 at 9:00 a.m. at City Hall, Room 1158, 700 5 North Main Street, Las Cruces, New Mexico. 6 7 DRC PRESENT: Robert Kyle, Community Development 8 Mark Dubbin, Fire Department 9 Rocio Dominguez, Engineering Services -CD 10 Meei Montoya, Utilities 11 Tom Murphy, MVMPO 12 13 STAFF PRESENT: Katherine H-Rogers, Community Development 14 Becky Baum, Recording Secretary, RC Creations, LLC 15 16 OTHER PRESENT: Pat Montoya 17 18 I. CALL TO ORDER (9:01 a.m.) 19 20 Kyle: Okay I'm going to go ahead and call this meeting of the DRC to order. It's 21 February 8th and it's approximately 9:01. 22 23 II. APPROVAL OF MINUTES - February 1, 2017 24 25 Kyle: First order of business is approval of minutes. We have minutes from the 26 February 1st DRC meeting. Are there any corrections to note? I had 27 some related to just attendance but that's been corrected. So if there's no 28 other corrections to the minutes I'd accept a motion to approve. 29 30 Murphy: Move approval. 31 32 Dubbin: Second. 33 34 Kyle: It's been moved and seconded. Case 70977: University Mesa No. 3, Replat No. 6 44 A request for approval of a non -administrative replat known as 45 University Mesa No. 3, Replat no. 6. 1 1 • The proposed subdivision will be subdividing Lot 10 of University Mesa 2 No. 3, Replat No. 1 into two new single-family residential lots. 3 . The proposed subdivision encompasses 0.436 +/- acres, is zoned R-3 4 (multi -Dwelling Medium Density) and is located on the north side of Wall 5 Avenue, 550 +/- feet west of its intersection with Oleta Drive; a.k.a. 273 6 Wall Drive. 7 • Submitted by Patricio Montoya. 8 9 Kyle: Next item is new business. We have Case 70977, University Mesa 10 Number 3, Replat Number 6. 11 12 H-Rogers: This particular project is taking an existing lot in an existing subdivision 13 and splitting it into two single-family residential lots. The property is zoned 14 R-3 which is a multi -dwelling medium density and it's a little under half an 15 acre total, 0.436. It's located along Wall Avenue at 273 Wall Avenue. Pat 16 Montoya is the applicant. It's pretty straightforward. It's the end of a cul- 17 de -sac. Staff hasn't identified any significant issues and it's meeting all 18 the requirements of the zoning and subdivision code at this point in time 19 and so staffs going to recommend approval of this particular case. 20 21 Kyle: Okay. Applicant do you have anything to add? 22 23 P. Montoya: No. I appreciate all the work you do for this and I know it's time consuming, 24 however all I have is time. I'm retired, how's that. And then I actually can 25 practice now for maybe another one that may happen later, but otherwise 26 everything's been great. The City's been good and showing me the path 27 and how to go about in doing this. This is my first one. I've built other 28 homes but not where I need to split which is great. It could be a long 29 (inaudible). 30 31 Kyle: Very good. I'll go around the table then for the reviewing departments. 32 MPO. 33 34 Murphy: No issues. 35 36 Kyle: Las Cruces Utilities. 37 38 M. Montoya: The Las Cruces Utilities on the second review of this case and the reason 39 we're still on the second review and not being able to approve it is 40 because the newly created lot 10B does not have any utility stub out to 41 this lot because this was originally subdivided into just one lot and now 42 you are making two lots. So all the utility stub out as far as. we can see 43 from the records drawing and from the curb stem will all point to lot 10A. 44 So this new lot 10B would require pavement cut in order to get ... 45 46 P. And we have commented to your surveyor, wanted your surveyor ... for you to contact the new connection so you more or less can get a cost. P. Montoya: Right. M. Montoya: And then ... P. Montoya: That's correct. M. Montoya: Okay. So ... P. Montoya: One word just to say when I looked at the lot there's actually, that lot would sit with two homes on it and there's two separate water, sewer, and gas on each lot. It's located here, the other one's located right there. M. Montoya: No as far as for lot 10B there are ... P. Montoya: Okay. M. Montoya: No utilities stub out. That we researched the record drawing and where the curbs stand there are no utility stub out. So most likely pavement cut would be needed in order to provide separate utility services. We don't want to manifold you know from 10A ... P. Montoya: No. M. Montoya: Into 10B. P. Montoya: I understand. M. Montoya: So there will be some cost associated with doing that and then so yesterday we had provided an estimate to the planner and the, I don't know have you receiving that. P. Montoya: No, not yet. M. Montoya: Okay. Otherwise ... H-Rogers: He's out sick. M. Montoya: Okay so I have a copy in here like I say this is only an estimation. When you are ready to do the house plan they might change a little bit ... P. Montoya: We mainly just wanted to let you know there would be cost, the utility cost associated with this. P. Montoya: Absolutely. M. Montoya: Replat. Okay. So since we still have pending comments on review two I don't know what we do in here that we just ... Kyle: Well Meei your pending comments is that newly created lot or one of those lots needs new services run to it, correct? M. Montoya: Right. Kyle: There's nothing else besides that from the utility standpoint, comment - wise. It's just that they need to extend utilities. M. Montoya: They need to agree to pay for the utility costs ... Kyle: To extend ... right. M. Montoya: To provide separate utility services. Kyle: There's a note on the plat already that says the developer is responsible for the utility stub outs and easements, etc. So it is on the record on the plat that they are responsible. Mr. Montoya is the property owner, correct? P. Montoya: That's correct sir. Kyle: All right, you are aware that you will need to bring in new utility stub outs and line extensions. P. Montoya: That's correct. Kyle: To that property. P. Montoya: I was made aware from Adam. Kyle: Okay. P. Montoya: And he suggested I call Munoz... H-Rogers: Moreno. Kyle: Bob Moreno. L1 1 2 P. Montoya: I'm sorry, Moreno from the Utility Department and have a talk with him so. 3 4 Kyle: Okay. 5 6 P. Montoya: And I will, absolutely. 7 8 M. Montoya: Okay. 9 10 Kyle: So on the record you're fully aware that you're responsible for those items 11 12 13 P. Montoya: Yes. 14 15 Kyle: Prior to certainly any permits being issued for the house on that lot that 16 does not already have services. 17 18 P. Montoya: Right. 19 20 Kyle: So since we actually have the property owner, not just a representative ... 21 22 M. Montoya: Yes. 23 24 Kyle: I think that's very clear what needs to be done. Anything else then Meei? 25 26 M. Montoya: That's it. 27 28 Kyle: Okay.
