08-26-1996SpecMtg i MINUTES OF A SPECIAL MEETING OF 2 THE HOUSING AUTHORITY OF THE CITY 3 OF LAS CRUCES BOARD HELD ON 4 AUGUST 26, 1996 5 6 The Board Meeting of the Housing Authority of the City of Las Cruces was held at 6:30 7 8 p.m. at 926 S. San Pedro, in the City of Las Cruces, State of New Mexico. 9 10 1. Roll Call. ll 12 The meeting was called to order by Lorraine R. Gutierrez, Chairperson. 13 14 MEMBERS: Lorraine R. Gutierrez, Chairperson 15 Frances F. Williams, Vice Chairperson 16 Trevas Y. Ryan, Commissioner 17 18 ABSENT: Alice E. Holmes, Commissioner 19 (excused) 20 21 OTHERS: Andrew T. Holguin, Interim Exe. Director 22 Neil Weinbrenner, Attorney 23 24 Chairperson Gutierrez noted that Commissioner Holmes would not be present at the 25 26 meeting, however, the commissioner stated that she would call in at approximately 7:00 27 28 p.m. in order to place her vote pending the outcome of Mr. Weinbrenner's legal advice 29 30 concerning possible litigation. 31 32 2. Closed Session - a discussion regarding litigation. 33 Chairperson Gutierrez entertained a motion to enter into closed session at 6:40 p.m. 34 So moved by Vice Chairperson Williams. Seconded by Commissioner Ryan. 35 Chairperson Gutierrez took a vote for approval: 36 Vice Chairperson Williams voted in favor. 37 Commissioner Ryan voted in favor. 38 Motion carried. 39 Chairperson Gutierrez entertained a motion to reconvene into open session at 7:02 40 p.m. Seconded by Vice Chairperson Williams. Seconded by Commissioner Ryan. 41 Chairperson Gutierrez took a vote for approval: 42 Vice Chairperson Williams voted in favor. 43 Commissioner Ryan voted in favor. 44 Motion carried. 45 The Board recommended that they provide Mr. Weinbrenner the authority to advise the 46 Court that the HACLC would not appeal the decision to release the documents 47 requested by the Sun-News with regard to the settlement agreement and other 17 w 46 The Board recommended that they provide Mr. Weinbrenner the authority to advise the 47 Court that the HACLC would not appeal the decision to release the documents 48 requested by the Sun-News with regard to the settlement agreement and'other 49 information which the Judge Robles examined "in camera." Chairperson Gutierrrez 50 entertained a motion authorizing Mr. Weinbrenner to advise the Court of the HACLC's 51 decision not to appeal Judge Robles' decision. So moved by Vice Chairperson 52 Williams. Seconded by Commissioner Holmes (via telephone conference). 53 Chairperson Gutierrez took a vote for approval: 54 Vice Chairperson Williams voted in favor. 55 Commissioner Ryan voted in favor. 56 Commissioner Holmes voted in favor. 57 Motion carried. 58 At 7:15 p.m. the Board resumed into closed session to discuss matters of litigation with 59 regard to the request for information made by the Sun-News. At 9:00 p.m. the Board 60 came out of closed session to resume the meeting in open session. The Board 61 directed Mr. Holguin to contact the board's attorney (Mary Torres) to ensure that the 62 correspondence had been addressed with regard to the Housing Authority. 63 3. Recommendations and Comments by Board Members. None were made. 64 4. Other Business. No other business was brought before the Board. 65 5. Adjournment. 66 Chairperson Gutierrez entertained a motion for adjournment. So moved by 67 Commissioner Ryan.
