03-28-1994SpecMtg i+ i LAS CRUCES METROPOLITAN PLANNING ORGANIZATION MEETING 1 MONDAY, MARCH 28 , 1994 2 The following is the Agenda for the Las Cruces Metropolitan 3 Planning Organizations ' Policy Committee Special Meeting held on Monday, March 28, 1994, at 4 : 30 p.m. , in the Las Cruces 4 City Hall , Conference Room A, 200 North Church Street, Las Cruces, New Mexico . 5 MEMBERS PRESENT: Ray B. Luchini , Chairman (Dona Ana County) 6 Kenneth Miyagishima (Dona Ana County) Edward Southworth (Town of Mesilla) 7 Tommy Tomlin (City of Las Cruces) Herculano Ferralez (City of Las Cruces 8 John Haltom (City of Las Cruces) 9 MEMBERS ABSENT: Jesus M. Caro (Town of Mesilla) Michael Cadena (Town of Mesilla) 10 STAFF PRESENT: Brian Denmark, MPO Officer 11 Michael Parks, City Planning David Carpenter, City Planning 12 CALL TO ORDER 13 Mr. Luchini called the meeting to order. 14 NEW BUSINESS 15 Mr. Luchini said, the first order of business is approval of 16 the FY 1994-95 Unified Work Program - Resolution 94-003 . 17 Mr. Haltom moved for approval of Resolution 94-003 . Mr. Southworth seconded . Mr. Luchini said, it ' s been moved and 18 seconded, is there any discussion? 19 Mr. Denmark said, Mr. Chairman, in correspondence from the State Highway and Transportation Department, they wanted us to 20 be more specific on the project/tasks budget which is within your packet . All we did is, since it ' s the same amount of 21 money--there ' s no change in the amount of funding that we ' ve received, a further breakdown. It ' s something we were waiting 22 on a response from them on how they wanted it broken down: Section 8 money dealing with public transportation planning. 23 Other than that, Mr. Chairman, the main projects that we ' re currently working on will be part of the UWP are the MPO 24 Transportation Plan and the elements associated with that including bike path movement and transportation. 25 Mr. Haltom said, I move for approval of the amendment . Mr. 26 Southworth seconded. Mr. Luchini said, we already have a motion on the floor. Mr. Haltom said, I 'm making this motion 27 as an amendment to the previous motion. Mr. Luchini said, alright, all those in favor of the amendment, say aye . Any 28 opposed? The amendment carried unanimously. 29 Mr. Ferralez said, Mr. Chairman, I have a question. On the jproposed Resolution, Page 4, under Previous Results and 301 Proposed Programs, the only question I have since it refers to BLM land and long-range planning is what did we ever end up 31 with on the right-of-way toward the south (Reliever Route) . 32 Mr. Parks said, what we ended up with was a 250 foot corridor that extends from approximately where Weisner Road is, coming south for approximately three miles and makes an "S" curve ( it ' s difficult to describe without a map) . The "S" curve would start south of Weisner, then it curves to the west one mile, and then it goes straight south from there so that it i misses the Talavera Subdivision. That has been surveyed and is deeded to the County. �i Mr. Denmark said, so, we have a complete link of right-of-wa from US 70 X11 the way down. 1 Mr . Parks said, where it crosses State Land, we don ' t have that yet, but where it goes through BLM land, we do have that . 2 Mr. Ferralez said, as far as BLM land is concerned, we do 3 have that, and we ' re proceeding with the acquisition of the State Land. 4 Mr. Parks said, yes . 5 Mr. Denmark said, yes, they submitted a master plan of the 6 area just adjacent to Onate High School and where the proposed or planned nature park is . As part of that, they did an area ? transportation master plan that matched the MPO overall network. As part of that, they also show the arterials going 8 down. They ' ve been very supportive as far as trying to conform to our MPO plans . The BLM has also been supportive 9 and they have granted us right-of-way. 10 Mr. Ferralez said, the reason I asked is because I really believe that ' s something that ' s going to have to be 11 Prioritized for US 70, and the securing of right-of-way is very important. That way a year from now or five years from 12 now, the right.-of-way is there . 13 Mr. Luchini said, okay, if that ' s all , I guess we 're ready to vote on the main motion as amended. All those in favor, say 14 aye . Any opposed? The motion carried unanimously. 15 Mr. Miyagishima said, Mr. Chairman, can you tell me when that four lane on Highway 85 (Valley Drive) near Westwind Road is 16 going to be completed? 17 Mr. Parks said, there is a proposal to expand Valley Drive to four lanes from Picacho north to Engler. Currently, there is 18 no proposal at this time to extend it beyond Engler Road. The City is taking the lead on doing the design for that, and as I 19 understand it, they ' ve submitted the preliminary design to the State for review. Right now, we 're awaiting their comments . 20 Mr. Miyagishima said, would that be this fiscal year. 21 Mr. Denmark said, we 've got monies for this next fiscal year 22 to begin final design to carry that project . What it looks like will happen is final design will be done from US 70 to 23 Engler Road and then construction will occur in phases . You' ll see like the first half built, then you ' ll see the 24 other half . We have full support from the District Engineer, Tony Sayre , and also our Highway Commissioner, Dr. Ford. 25 Mr parks said, 1996-97 is the proposed target . That ' s if 26 everything with environmental goes okay. We have to do an environmental study now on all federally funded projects . 27 They ' ll be looking for underground storage tanks and any kind of pesticide contaminants from adjacent farms , and once we get 28 the green light on that, then construction can proceed . 291 Mr. Miyagishima said, I guess they ' re going to take into I consideration business along this route are going to be 30 impacted. I know there ' s only a certain degree that we can probably ask, but hopefully they ' ll take that into 31 consideration. If there ' s any way to facilitate the traffic and make it a little bit easier for the businesses . I would 32 like to see that and I don 't know if there ' s any precautions that we could take? i I Mr. Parks said, actually, as part of the final design one required element is a traffic congestion mitigation plan that will have to be designed to detour traffic, to route traffic , to accommodate the area businesses, so that will be part of 1 the final design. 2 Mr. Miyagishima said, but as far as going all the way to Westwind, that ' s not in this timeframe . 3 Mr. Parks said, not at this time . 4 Mr. Haltom said, b the way,y, where are we on the Engler Road 5 issue? s Mr. Denmark said, we have not heard back from the ETZ . They have basically left it on the table and have requested that 7 the City Engineering staff, as a part of their planning of the proposed detention facility in that area, design for the 8 ability to provide that right-of-way along there . So, we have still maintained that as part of the plan, but we haven 't 9 received word from them. The reason we haven't come back to You for further direction is because we 've been tied up with 10 the ISTEA mandate on our transportation plan so we wanted to wait until we got that done . We didn ' t have much time to go 11 back to Engler Road, but our philosophy is that it ' s still shown on our Major Thoroughfare Plan, so if development does 12 occur there, they would still have to comply with the Design Standards which requires right-of-way. 13 Mr. Haltom said, may we 14 forever. Y bypass the ETZ if they sit ori it 15 Mr. Denmark said, our approach is to come back to you and ask for direction. Legally, you can take action. 16 Mr. Tomlin said, I think before you bring that back, the 17 people out there need to be notified . If someone is going to light the fire, it ' s got to be the residents out there who are 18 opposed to that proposal and who were here at the meeting. They were talking about changing the density so they didn ' t 19 need that kind of a road. 20 Mr. Denmark said, due to changes in the Bylaws , we would need to notify them again when we bring that case back up. It ' s a 21 requirement that we have to notify them. 22 Mr. Tomlin said, I would prefer that if the reason that it ' s not done is because the ETZ Commission or Authority just 23 decided not to deal with the issue, I would still like for them to deal with the fire rather than have us burn having to 24 deal with it . That was what the people were told . The ETZ Commission needs to be made aware that we 're still waiting to 25 hear from +?iem on this issue . 26 Mr. Denmark said, I 'm assuming that part of the hold might be their activity with the County ' s Comprehensive Plan. Essentially what they 're doing is dealing with the County and 27 the ETZ area at the same time . So, that land use policy that 28 they develop as a part of the planning area might be what Ithey 're waiting for. That ' s something we can check into . 29IMr. Tomlin said, we need that input and information before we 30 o any further.. 31 r • Ferralez said, Mr. Chairman, I wonder if we shouldn' t send letter to the ETZ as a reminder; regardless as to whether or 32 aot it ' s answered. That way, if we take action and they throw ' t back in our faces, we can say that we sent a reminder. I ove that we authorize the writing of a letter of reminder. Ir. Southworth seconded. Mr. Luchini said, there ' s been a notion and a second . Is there any discussion. If not, all hose in favor say, aye . Any opposed? DISCUSSION/OPTIONS: None { LAS CRUCES METROPOLITAN PLANNING ORGANIZATION RESOLUTION NO. 94-004 AN AMENDMENT TO THE FY 1994-95 ANNUAL ELEMENT (AE) AND THE FY 1995-96 THROUGH FY 1999-2000 TRANSPORTATION IMPROVEMENT PROGRAM (TIP) TO INCLUDE THE USE OF ENHANCEMENT FUNDS TO DEVELOP THE LAS CRUCES RAILROAD DEPOT. The Las Cruces Metropolitan Planning Organization' s Policy Committee is informed that : WHEREAS, the Las Cruces Metropolitan Planning Organization approved the FY 1994-95 through FY 1999-00 Annual Element\Transportation Improvement Program (AE\TIP) on February 9, 1994 . These documents can be amended as directed by the MPO Policy Committee, and; WHEREAS, New Mexico State Highway and Transportation Department (NMSHTD) maintains a separate and concurrent "State AE\TIP" process ,that must incorporate the AE\TIP from the LCMPO, and; WHEREAS, due to the nature of the Intermodal Surface Transportation Efficiency Act (ISTEA) , Enhancement Funds are made available through NMSHTD to restore transportation facilities, and; WHEREAS, the State Highway Commission has stated a willingness to funds creative enhancement projects if evaluated through a public process, and; WHEREAS, the project is supported locally, an amendment to the MPO' s AE\TIP has been requested by the City of Las Cruces . THE MPO POLICY COMMITTEE FINDS THAT it appears to be in the best interest of the MPO that the amendment be APPROVED and ACCEPTED by the Policy Committee. NOW, THEREFORE, the Policy Committee of the Las Cruces. Metropolitan Planning Organization, determines, orders and resolves as follows : (I) THAT page five (5) of the Las Cruces MPO' s FY 1994-95 through FY 1999-00 AE\TIP be amended as shown5� I MI in the attached Exhibit A.
