03-31-1999 I DEVELOPMENT REVIEW COMMITTEE (DRC) MEETING 2 March 31, 1999 3 City Planning Department Conference Room 4 5 Following are the summary minutes from the Development Review 6 Committee (DRC) meeting on Wednesday, March 31, 1999, in the City 7 Planning Department Conference Room, 575 S . Alameda Blvd. , Las 8 Cruces, New Mexico. 9 10 Members Present : Brian Denmark (PLNG) 11 Jim Ericson (DSD) 12 Jorge Garcia (JU) 13 14 Staff Present : Tony Aguirre (JU) 15 Paul Dugie (CLC Engineering) 16 Mike Johnson (Traffic Operations) 17 Robert Kyle (PLNG) 18 Vince Sanchez (JU) 19 20 Others Present : Ernie Campos 21 David Chavez 22 Julian Chavez 23 Daniel Ruiz 24 Rollie Wright 25 26 27 I. CALL TO ORDER 28 29 Denmark called the meeting to order at 9 : 05 AM. 30 31 32 II. CASE INTRODUCTION 33 34 1. Pre-application meeting for 5-acre parcel on Davis Rd. 35 (Waivers) . (Moy) 36 37 Campos : Proposed 2-lot split off Carter Road and Davis and East 38 Mesa. 39 - now it' s 4-4 % acres 40 - basically, there are 2 lots 41 - INTENT: Have one of the sons take up residence on one of 42 the lots 43 - There have been spots of dedication in the area. 44 45 Kyle : Issue : whether or not DRC will support road improvements to 46 Davis and Carter Roads . 47 48 Ericson: 49 - My suggestion: Go out of get neighbors to sign rights-of- 50 way 51 - Our reason for wanting to get right-of-way: then City can 52 go in to upgrade it, improve it 53 - My problem is from "there south and more particularly 54 there north, in both directions . " 55 - You' re asking us not only to waive the improvement 56 standards, but create essentially an unimplementable operation 57 for us . We can' t maintain anything because . . . 1 r 1 - We' re willing to do all the work, but we need some help 2 from the neighbors up there . 3 4 Julian Chavez presented a plat (?) displaying the dedicated 5 areas . 6 7 Kyle : The zone is RE-M. 8 - One home is already on the property. They want to bring 9 on a second home . They are legal right now. 10 11 Denmark: The more it' s subdivided, and the more people coming out 12 there, creates bigger problems for us . So if we don' t solve some 13 of these right-of-way and drainage problems, it' s going to reach 14 the point where we shouldn' t be supporting any further 15 development . 16 17 Ericson: You do have the option of taking it to the Planning and 18 Zoning Commission and staff recommending against it . If P&Z 19 turns you down, try your luck with Council . 20 But again, we need to find some way to work together with 21 the people out there to get the right-of-way lined up. You 22 probably have better connections with your neighbors than we do. 23 We will go out with you and knock on doors . 24 25 Campos : The request pretty much is to have ? ? ? (66) on up 26 Cortez . 27 28 Ericson: That would really help ! I 'm just asking him to help us 29 get in contact with him. 30 31 J. Chavez : This road is on my property. There are telephone 32 power poles in this side of the street . 33 34 Ericson: If we get it dedicated, we can deal with utility 35 companies . Even if we have to have them move it . . . even if we 36 have to pay them to move it, to be able to maintain the road, at 37 least it puts us on the footing to deal with the issue . 38 Right now it' s private. We can' t do anything. Our hands 39 are tied. That' s my problem. 40 All we' re asking for is for you to work with us . . . 41 My concern is continuing what we' re doing. It' s becoming 42 too big of a problem, from my perspective . 43 44 J. Chavez : Right now, these roads are being graded all the way up 45 to my property. And they [inaudible] come back over here, and 46 drop and continue . So I assumed all that had been dedicated, 47 with the exception of mine . 48 49 Ericson: I don' t know. We need to see . 50 My concern is right-of-way, right now. 51 52 J. Chavez : On right-of-way, I would give you the 25 foot here if 53 you wanted it . Actually, it says 120, ' but I ' ll give you 25 feet 54 if that' s what you require . 55 56 Mr. J. Chavez proceeded to describe that he wants his children to 57 be able to settle on this land, as it belongs to them. 58 2 1 Ericson affirmed that his concern is that there is no right-of- 2 way and he wants his (Mr. Chavez' s) help in getting right-of-way 3 there . 4 5 Ericson: It' s to all your benefits to be able to dedicate the 6 right-of-way, because it let' s us go in and maintain it, then. 7 I' ll go knock on doors with you and explain what we' re 8 doing. 9 10 Kyle : So if we get the dedicated right-of-way, does the committee 11 support a waiver to improve it? 12 13 Denmark: I don' t have any problem with that, but I think from 14 this point on we really need to get Council direction on policy 15 in how to address because every time it' s different . And then 16 people move out there and then they start complaining about 17 drainage, because there' s problems out there ! 18 19 Kyle : Based on the comments, or lack of, on the Work Session 20 Review of the Design Standards, I'd say we've got a little bit of 21 direction on that . 22 23 Denmark: I think they need to understand what' s really going on 24 out there . 25 26 Ericson: Long term, we' re looking at four (4) lots; 2 fronting on 27 Davis and 2 fronting on Carter. 28 29 J. Chavez : Just one person lives out there right now. 30 31 D. Chavez : Our main concern is getting that lots separated. 32 33 J. Chavez : Right now, the one that' s over by itself is the main 34 concern. But in the future, that' s (148) . 35 36 Kyle : To do this one now, you' re looking at, at earliest, June, 37 before it' s all said and one . 38 . . . This one would have to go through a preliminary and 39 final plat . 40 41 Ericson: We need to see what we've got as far as right-of-way. 42 43 Denmark: Just work with Ernie and Steve on that and then get back 44 with us on where we are, and then we' ll make a call at that time . 45 Is there a timing issue with those other two (2) lots? 46 47 J. Chavez : No, that' s the one we' re really interested in right 48 now. 49 50 Denmark: The other one can be later on down the road. 51 52 J. Chavez : Yeah. 53 54 Kyle : We can get back to you on next Wednesday. 55 56 Ericson: Okay. 57 58 3 1 2 . Preapplication meeting for Porter Road subdivision 2 (waivers) . (Moy) 3 4 Kyle : Here' s Porter Drive . . . . There are 2 existing homes . 5 In 1990, they came in and were issued a permit for the 6 second mobile home on the property. This is probably the exhibit 7 that was used at the time . 8 9 Denmark: We assume that they thought it was 2 lots . They just 10 made the assumption. 11 12 Kyle provided more background information. 13 14 Kyle : The problem is, the access to this back property is off of 15 a 27-foot private road utility easement . There' s a huge 20-foot 16 arroyo easement (drainage easement) . 17 What would the committee support? Do you want to see a flag 18 lot or access to this lot remain from a private road? 19 It' s just in adding a second mobile home. It' s replacing 20 one . 21 22 Ericson: My concern: We' re buying the right-of-way for the 23 arroyo, but we need to make sure we' re not buying a driveway as 24 well . 25 26 Dugie : Right . We do have that right-of-way that we' re trying to 27 purchase out there for that area to develop in. 28 29 Ericson: Right . And we' ll just purchase that . 30 31 Dugie : Let' s make sure that that easement and the right-of-way 32 match up so that when the purchase does go through, we won' t have 33 a whole lot ? (209) . We won' t have to worry about moving a 34 mobile home or anything like that . 35 36 Ericson: Right . Or leaving this lot without any access . 37 38 Dugie : Right . 39 40 . . . 41 42 Denmark: The committee doesn' t have any problem with an easement? 43 Just providing an easement to that back property, as long as it 44 complies to our- 45 46 Ericson: It' s existing. 47 48 Kyle : Technically, I don' t know if we need to treat this as like 49 a waiver to the design standards for the 40-foot ? (Permanent, 50 214) dead end road, or just treat it as a driveway through this 51 thing in-house . 52 53 Denmark: I ' d say do it in-house as a driveway. Have them work 54 with us on the needed right-of-way that we need. 55 56 Kyle : We have our 65 feet on Porter? 57 4 1 Dugie : Everything' s been taken care of with the development of 2 Porter. 3 4 Jorge : Are utilities in that, road utilities easement ? In the 5 back lot? 6 7 Ruiz : It' s propane . 8 9 Kyle : I'm just going to ? The utility and permanent property 10 review just so it' s not public utility, but . . . 11 12 Denmark: I would say, just between you and Paul and whoever needs 13 to be involved [inaudible] administratively. 14 15 Ericson: Just like I said, just make sure that . . . and I guess 16 now would be the time if we can identify what we want to just 17 [inaudible] . 18 19 ? : Like I said, the ? ? ? (Leaps and bounds, 227) have been done 20 several years ago, and they' re in right-of-way' s office right 21 now. 22 23 Kyle : Both of these are permitted septic tank systems? Because 24 we' re already below the 3/4 ? (230) if we take this easement, 25 this right-of-way. So . . . 26 27 ? : I' ll just need to make sure I don' t fall below the 5 acre, I 28 mean % acre . 29 30 Ernie : What' s going to happen [inaudible] MPO? 31 32 Ericson: We' ll cross that bridge when we come to it . 33 34 Denmark: Just, make him put it and give us an easement . 35 36 Kyle : Plus, I ' d say [inaudible] that' s all ? (235) know exactly 37 how much dedicated right-of-way we have from ? (satellite, 235) . 38 39 Denmark: I guess we ? (don' t/we' ll, 236) need it, but we can work 40 with them on a setback or something since it' s non-conforming. 41 42 Kyle : Assuming this is the center line, I've scaled it off and 43 they can still give out 65 feet and meet setbacks and everything 44 else, so it' s no problem. I just don' t know what' s out there . 45 46 Ericson: We want to make sure that our right-of-way goes to the 47 back of the side lot . 48 I'd like to make sure that, at the minimum, we've got a 49 building setback. But, an easement would be nice, but we need to 50 make absolutely the right-of-way goes to the back of the 51 sidewalk, or wherever. 52 53 Kyle : I assume also we could go with the 120 foot width instead 54 of instead of 100 . 55 56 Denmark: Yeah. I think Council approved that . 57 58 Kyle : So 60 feet off the center line . So it' s 65 . 5 1 Just identify so we can see what we've got . 2 3 Ericson: Then we can figure out where we want to vote, like if we 4 want an easement or just a setback. 5 6 Denmark: You' re just going to have to work with staff on it and 7 get all the issues resolved quickly. 8 9 Kyle : Submit it once things have been identified. 10 11 Denmark: Yeah, we don' t need to see it, unless something comes 12 up. 13 14 15 16 III.
