RES 19-20-047 ALL SIGNED LAS CRUCES UTILITIES BOARD RESOLUTION NO. 19-20-047 A RESOLUTION APPROVING A SOLE SOURCE PRICE AGREEMENT FOR BIOXIDE PLUS 71 TO EVOQUA WATER TECHNOLOGIES LLC OF SARASOTA, FLORIDA, IN AN AMOUNT NOT TO EXCEED $91,220.00 PER YEAR FOR ONE (1) YEAR WITH THE OPTION OF THREE (3) ADDITIONAL ONE (1) YEAR RENEWALS SUBJECT TO APPROVED BUDGET APPROPRIATIONS AND ANNUAL RENEWAL FOR THE USE IN CONTROLLING CORROSION AND ODOR IN THE CITY'S WASTEWATER COLLECTION SYSTEMS. The Board of Commissioners for the City of Las Cruces Utilities, on behalf of the City of Las Cruces, is informed that: WHEREAS, the Utilities Department has four (4) lift stations in the wastewater collection systems, which require Bioxide and one (1) of the four (4) lift stations that requires Bioxide Plus 71; and WHEREAS, it has been determined that these lift stations cannot use ferrous chloride control and must use a nitrate salt for this process; and WHEREAS, it has been determined at this time that Bioxide, which is a trade name for nitrate salt, may be used in these lift stations without causing damage to the equipment; and WHEREAS, the Utilities Department staff established that there is only one supplier of Bioxide at this time, and that Evoqua Water Technologies LLC, of Sarasota, Florida, is the supplier of Bioxide; and WHEREAS, the cost of the Bioxide would be charged at $3.169 per gallon (in minimum loads of 3,800 gallons per truckload) and the cost of Bioxide Plus 71 would be charged $3.955 per gallon (in minimum of 3,800 gallons per truckload); and WHEREAS, it is recommended that the Las Cruces Utilities Board of Commissioners approve the contract with Evoqua Water Technologies LLC. This request is to purchase Bioxide pursuant to Section 24-95 of the Procurement Code, whereby a determination of sole source can be based upon the provision that there is only one source for the required supply. The attached Price Agreement #19-20-47 and Sole Source Determination for Evoqua Water Technologies, LLC, of Sarasota, Florida, is the only supplier that met all chemical criteria and technical specifications. Bioxide and Bioxide Plus 71 is used in controlling corrosion and odor in the City's wastewater collection systems at the four (4) designated lift stations. These lift stations require a chemical treatment to control corrosion and odor. Normally, Ferrous Chloride is used for odor control, but these lift stations require the odor control chemical be injected directly into the lift station wet well. Ferrous Chloride, which is typically used for odor control in the collection systems, cannot be used in these lift stations as it severely damages equipment. For this type of application, nitrate salts are the only alternative. Bioxide is the trade name for the nitrate salt. The quantities listed are estimated usage only and will be ordered by Utilities staff on an as-needed basis under the not to exceed $91,220.00 guarantee price agreement, for one (1) year with the option for three (3) additional one (1) year renewals, subject to approved budget appropriations and annual renewals. These lift stations require a chemical treatment to control corrosion and odor. Normally, Ferrous Chloride is used for odor control, but these lift stations require the odor control chemical be injected directly into the lift station wet well. Ferrous Chloride, which is typically used for odor control in the collection systems, cannot be used in these lift stations as it severely damages the equipment. For this type of application, nitrate salts are the only alternative. Bioxide is the trade name for the nitrate salt. The Utilities Department staff established that there is only one supplier of Bioxide at this time. A request is being made to purchase Bioxide pursuant to Section 24-95 of the Procurement Code, whereby a determination of sole source can be based upon the provision that there in only one source for the required supply.
