RES 20-21-LCU016 ALL SIGNED LAS CRUCES UTILITIES BOARD RESOLUTION NO. 20-21-LCU016 A RESOLUTION TO APPROVE THE UPDATED WATER AND WASTEWATER IMPACT FEE AND REVISIONS TO THE WATER AND WASTEWATER DEVELOPMENT IMPACT FEE SCHEDULE TO MEET AMERICANS WITH DISABILITIES ACT REQUIREMENTS. The Board of Commissioners for the City of Las Cruces Utilities, on behalf of the City of Las Cruces, is informed that: WHEREAS, on February 6, 2019, TischlerBise, Inc. ("TischlerBise"), of Bethesda, Maryland, was contracted to review and provide an update to the Water and Wastewater Impact Fees. TischlerBise took into consideration Water/Wastewater usage, capital projects, the most recent Water/Wastewater rate reviews, growth projections, land use assumptions, and outstanding debt; and WHEREAS, a credit is included in the fee calculation to make sure that new development does not pay twice for the same improvement costs. Costs for utility capacity improvements are captured both in impact fees and partially in ongoing utility rates. The credit is set up to reduce the impact fee rate for the amount of outstanding debt that is anticipated to be covered by utility rates, thereby avoiding a situation where a user pays twice for the same capital improvements and expansion; and WHEREAS, the initial assumption from TischlerBise was to use the American Water Works Association guidelines for meter capacity. However, due to the recent Investment Grade Audit, we have actual capacity and current metering technology for residential and larger meters. We then used the residential meter capacity to scale up and establish the appropriate Water and Wastewater Impact Fees; and LCU FY20 06/20 Rev. 4 LCU Board Resolution No. 20-21-LCU016 Page 2 of 3 WHEREAS, the draft Water and Wastewater Impact Fee Update was presented to the Capital Improvements Advisory Committee ("CIAC"), on October 17, 2019. On December 19, 2019, the CIAC approved the Water and Wastewater Impact Fee Update. On January 9, 2020, the Water and Wastewater Impact Fee Update was reviewed by the Las Cruces Utilities ("LCU") Board of Commissioners ("Board") during a Work Session. On September 14, 2020, the Water and Wastewater Impact Fee Update was presented to City Council; and WHEREAS, LCU staff recommends approval and authorization to make formatting revision to meet Americans with Disabilities Act requirements for posting on the City of Las Cruces website; and WHEREAS, LCU staff is also recommending the LCU Board approve the implementation of the revised Water and Wastewater Development Impact Fee Schedule as attached in Exhibit "A"; and WHEREAS, the Water and Wastewater Development Impact Fees Schedule will be effective on December 1, 2020. NOW, THEREFORE, Be it Resolved by the Board of Commissioners for the City of Las Cruces Utilities, on behalf of the City of Las Cruces: (I) THAT the proposed Water and Wastewater Development Impact Fees Schedule, attached hereto as Exhibit "A", and made part of this Resolution is hereby accepted and approved. (II) THAT City staff is hereby authorized to do all deeds necessary in the accomplishment of the herein above. Once a project, that extends access to the water system,has been completed and the customer has been formally notified,the customer will have 90 days to execute a contract for the installment payment option. GENERAL TERMS-APPLICABLE TO ALL IMPACT FEES For property owners who agree to pay the Customer Surcharge portion or, Total Surcharge applicable to Developed Property portion with the installment payment option,whether they are the utility customer or not (in the case of renters/lessees), the monthly payment amount will be billed to the property owner. Failure to pay the sums due may result in termination of all City utility service to the property; in a municipal lien being filed on the property; and in any other collection remedy available to the City. The "due on sale or transfer" requirement also applies to foreclosure, deed in lieu of foreclosure,or short sales, and to probate or death transfers. GENERAL TERMS-APPLICABLE TO ALL IMPACT FEES For property owners who agree to pay the Customer Surcharge portion or, Total Surcharge applicable to Developed Property portion with the installment payment option, whether they are the utility customer or not (in the case of renters/lessees), the monthly payment amount will be billed to the property owner. Failure to pay the sums due may result in termination of all City utility service to the property; in a municipal lien being filed on the property; and in any other collection remedy available to the City. In the event the property owner sells or transfers ownership of the property when there is a Customer Surcharge balance due, the full unpaid balance is due on or before City utility service for the property is transferred to a new customer. The "due on sale or transfer" requirement also applies to foreclosure, deed in lieu of foreclosure,or short sales, and to probate or death transfers. BACKGROUND: On February 6, 2019, TischlerBise, Inc. ("TischlerBise"), of Bethesda, Maryland, was contracted to review and provide an update to the Water and Wastewater Impact Fees. TischlerBise took into consideration Water/Wastewater usage, capital projects, the most recent Water/Wastewater rate reviews, growth projections, land use assumptions, and outstanding debt. A credit is included in the fee calculation to make sure that new development does not pay twice for the same improvement costs. Costs for utility capacity improvements are captured both in impact fees and partially in ongoing utility rates. The credit is set up to reduce the impact fee rate for the amount of outstanding debt that is anticipated to be covered by utility rates, thereby avoiding a situation where a user pays twice for the same capital improvements and expansion. The initial assumption from TischlerBise was to use the American Water Works Association guidelines for meter capacity. However, due to the recent Investment Grade Audit, we have actual capacity and current metering technology for residential and larger meters. We then used the residential meter capacity to scale up and establish the appropriate Water and Wastewater Impact Fees.
