Please notify the Library at least 24 hours before the meeting at telephone number 528.4000 or TTY 528-4008. 1 2 THOMAS BRANIGAN MEMORIAL LIBRARY 3 ADVISORY BOARD SPECIAL MEETING 4 LAS CRUCES,NEW MEXICO 5 February 1,2002 6 The February 1, 2002, Thomas Bramgan Memorial Library Advisory Board Special 7 Meeting was called to order at 9.15 a.m. Roll call was answered by- Jame Matson, Roy 8 Fister, Steven Givens, and Paul Comeau. Also present was Rima DeFord, System Services 9 Librarian. Special Guest Chnstme Ochs, Land Manager; Louis A. Roman, Public 10 Services Director; and Todd Howell, P.D S 11 DISCUSSION OF BRANIGAN ESTATE LAND 12 Ms. Ochs discussed three specific issues regarding the Branigan Estate Lands. 13 a. Model Airplane Club 14 In view of the fact that the Model Airplane Club had been on the 15 property since the 50's, it is felt that a written lease is necessary In August 16 of 2000, a written lease was presented before the City Council. One of the 17 clauses in that lease agreement was to allow the Bramgan Trust to place a 18 'Tor Sale' sign on the property, and that the land could go up for sale and 19 the lease could be terminated at any time When the issue went before the 20 Council, there was concern regarding the sale of the land. It was believed 21 that the land was a park and the last remaining open space in that area. 22 There was general concern about the wording, which allowed exclusive use 23 by the Airplane Club, which kept the rest of the neighborhood off the park; I therefore, the item was tabled to a nonspecific date. It has been suggested 2 again to present the lease before the Council. Ms. Ochs feels that without 3 any type of written agreement the Bramgan Estate is at the mercy of the 4 Model Airplane Club Having something in writing would provide the s Estate with a point to negotiate in the future if the Board does decide to sell 6 the land or have other uses for the land. Basically, they wish to present the 7 same agreement with modification to the clause concerning the "For Sale 8 sign." Instead of saying a For Sale sign will be placed on the land and the 9 City will actively market the land, it will simply ask the Club to 10 acknowledge that this property is not a dedicated public park and may 11 someday be sold or designated for a municipal use The Airplane Club will 12 be given a 90 days written notice if the Branigan Trust intends to dispose of 13 the property and the Airplane Club will have first option to purchase the 14 land at its full appraised value 15 The next change will be to title the agreement as a "non-exclusive 16 use agreement" A clause will be added stating that the property will be 17 open to use by the general public when no flying activity is occurring. 18 Groups must seek permission for scheduling use of the property when such 19 use does not conflict with the Airplane Club activities. Also, the Club 20 cannot unreasonably deny use of the land to other groups. 21 Ms. Ochs has recommended that the Bramgan Estate hold on to 22 this land since the value is appreciating. Mr Fister expressed concern 23 regarding the mature trees on the lot which add to the value of the land. I Ms. Ochs explained that the agreement requires the Airplane Club to 2 maintain the land and would have to obtain pernussion from the City if they 3 ever desired to remove the trees. 4 Ms. Ochs recommended the Board take the lease forward as revised. 5 The Board members motioned and approved to present the lease as 6 revised before the City Council on Monday, February 11, 2002 7 b 331 East Court Avenue 8 Tierra Del Sol Housing Corporation has proposed to purchase this 9 land for $12,500 The property was appraised at $16,000, but Tierra 10 Del Sol is not in a position to offer more than $12,500 Habitat for 11 Humanity offered $13,000 in 1998 but is no longer interested in this 12 property Tierra Del Sol will be building affordable housing on the land 13 and has the money available to close on the sale Since this land is not 14 appreciating, Ms. Ochs suggested selling the land to Tierra Del Sol. 15 The Board motioned and approved the sale of the land on 331 East 16 Court Avenue for $12,500 to Tierra Del Sol Corporation. Mr Givens 17 abstained his vote due to being involved in business matters with Tierra 18 Del Sol. 19 c. 2 Acres Immediately North of S&P Lot (Isaac Duran Jr) 20 This parcel of land has been approved for sale, but Mr Duran has had 21 problems acquiring the funds and will not be purchasing the land. The 22 land will be put back on the market for $2 25 a square foot. Ms. Ochs 23 recommends a new appraisal on the land for future sale. No action was required from the Board If an offer is presented, Ms Ochs will advise 2 the Board at that time 3 Ms. Matson asked if there is a lease agreement with the City for the 4 Fire Station and ball field located on Branagan Estate land. Ms Ochs 5 stated there is no written lease agreement. From her research, she has 6 gathered that the City of Las Cruces manages the land in exchange for 7 the use of that land. When the land first became the Branigan Trust 8 Property, there were 90 plus acres, which required a lot of management 9 At this point, there are approximately, if the Court property is sold, 10 three and one half acres of marketable land left. After much discussion, 11 it was decided that it would be a good point to keep this issue in mind 12 for the future 13 ANNOUNCEMENTS Nothing to Report 14 PUBLIC PARTICIPATION Nothing to Report 15 ADJOURNMENT 16 With no further discussion, the meeting adjourned at 9 41 a.m. The next Branagan 17 Library Advisory Board meeting is set for February 25, 2002, at 2 00 p m. in the Library 18 Boardroom. 19 20 21 22
